This document process was developed by a conscious lawyer in New York, and we are reposting so it is widely available.

Use it to remove your consent, demand removal, and enforce liability for any installations of “smart” / “advanced” / “AMI” meter (i.e. trespassing technology). Utility executives and public officials can be held liable in their individual capacity for all harm caused, and for violating the U.S. Constitution.

Whether your utility has installed a “smart” meter on your home, or you still have an analog meter, use the document process below. It can be adapted for any region internationally.

HOW IT WORKS
Those who explicitly or implicitly (i.e. through failure to act) violate laws and your rights are liable individually if you contractually default them using a process such as this — in which you state the violations, demand your constitutional rights be upheld, state your terms, and provide an affidavit of facts which you affirm to be true. An unrebutted affidavit becomes judgment in commerce.

In the case of public officials in the United States, it appears that an additional key to enforcing liability is stating in writing that you accept their oath of office (to the Constitution). If they are not defending the Constitution, they become liable commercially and for treason. This is very likely applicable in all nations where public officials swear an oath of office.

Important: Throughout this process, TO BE SUCCESSFUL IT IS NECESSARY THAT YOU REBUT EACH PIECE OF MAIL YOU RECEIVE (PERTAINING TO THIS MATTER) – IN WRITING.  Think of every correspondence that you receive as an offer to contract. This is part of the ‘testing’ process to see if you are committed. Commitment + an effective process = success.

1. Notice and Demand:
This document is 4 pages long (and the pages are numbered at the bottom of each page).
  1. Insert date on top right of 1st page.
  2. Insert the following parties using the sample language (you are addressing the letter “TO” these parties [also, all zip codes should be in brackets (which indicates that you are not agreeing to subject yourself to Federal Jurisdiction by virtue of using a zip code)]:
    1. Governor of the State in which you live.
    2. CEO (Chief Executive Officer) or President of the Electric Company.
    3. CEO (Chief Executive Officer) or President of the Gas Company.
    4. CEO (Chief Executive Officer) or President of the Water Company.
    5. CEO (Chief Executive Officer) or President or Chair of the Governmental Agency in your state that oversees utility use of Public Buildings and Properties such as Parks, Schools and State Universities.
    6. CEO (Chief Executive Officer) or President or Chair of the Governmental Agency in your state that oversees utility distribution by utility companies and is endorsing smart technology.
    7. Optional: Add your local State senator and congressman.NOTE: For a sample of recipients, such as in the land commonly known as New York, click here.
  3. Insert your name and address (the letter is “FROM” you). Do not insert any salutation such as “Mr., Ms. or Dr.” as use of salutations has legal implications. Also, all zip codes should be in brackets (which indicates that you are not agreeing to subject yourself to Federal Jurisdiction by virtue of using a zip code).
  4. Insert the state where you are located in the 1st full paragraph of the letter in the blank where it reads: “the lands commonly known as _______________”.
  5. Insert date on signature page of letter.
  6. Sign the letter and write your name below your signature to the left of where the words “, All Rights Reserved” appear.
  7. Have 2 witnesses sign and witness your signature on the 2 lines under “Witnessing By”.
  8. Have your signature notarized by a Notary Public.
  9. Also, in the “cc” under the notary, insert the name and address of your local Sheriff and mail a copy of the letter and accompanying Affidavit of Specific Negative Averment to him/her (if your area has one).
  10. Note: You only need to sign and have witnessed and notarized ONE copy of the letter.
  11. Upon completion of the foregoing, you keep the original letter.
  12. Run as many copies of the letter as you are sending to recipients. On the top of each copy of the letter on the 1st page in the upper right hand corner write “Certified Copy”.
  13. Insert each letter with the accompanying Affidavit of Specific Negative Averment into an envelope for each recipient and address to such recipient. Send by certified mail (return receipt requested). See sample for shorthand way of addressing envelopes and cards to recipients.
  14. Keep a file with the original letter and receipts for certified mailings.
2. Affidavit of Specific Negative Averment:
This document is 2 pages long (and the pages are numbered at the bottom of each page).
  1. Insert your name in the blank on page 1.
  2. Insert date on signature page.
  3. Sign the Affidavit and write your name below your signature to the left of where the words “, All Rights Reserved” appear.
  4. Have 2 witnesses sign and witness your signature on the 2 lines under “Witnessing By”.
  5. Have your signature notarized by a Notary Public.
  6. Note: You only need to sign and have witnessed and notarized ONE copy of the Affidavit.
  7. Upon completion of the foregoing, you keep the original Affidavit.
  8. Run as many copies of the Affidavit as that you have one to attach underneath each letter. On the top of each copy of the Affidavit on the 1st page in the upper right hand corner write “Certified Copy”.
  9. Attach a copy or each Affidavit under each letter.
  10. Keep a file with the Affidavit.

California Civil Code (2009)
  • 1619. A contract is either express or implied.  (And if you didn’t say no, you said yes.)
  • 3515. He who consents to an act is not wronged by it. (The way they do business is in writing. If you didn’t send them a letter or notice to remove your consent, you have agreed to their terms, and thus have agreed to a reduction in rights.)
  • 3521. He who takes the benefit must bear the burden.  (Utilities and their executives – and many public servants – are taking the benefit.  They must, according to their law, accept the liability for all harm if the liability is enforced.)
  • 3523. For every wrong there is a remedy.  (We are not bound into something which would have us be as slaves, if we do not want to be.)
  • 3527. The law helps the vigilant, before those who sleep on their rights.
